Degrees of Sex Crimes

There are several different types/degrees of criminal sexual conduct, all of which come with serious Felony implications.

First Degree Criminal Sexual Conduct – Generally someone will be charged with this level offense if: sexual penetration is found, when the victim is under the age of 13 – if the perpetrator is 16 or older – or – the victim will be 13, 14 or 15 and the perpetrator is four years older (or more) than the victim; also, in those offenses where force or coercion is used, if the crime involves a weapon or an accomplice or if there are multiple criminal acts over a period of time.

Second Degree Criminal Sexual Conduct – The type of conduct that will lead to this charge is similar to that in First Degree; however, sexual penetration is not required. Rather, proof of sexual conduct is often sufficient..

Third Degree Criminal Sexual Conduct – Most Third Degree Sex Crimes will involve a victim that is handicapped (mentally or physically) or a patient of a health care professional. An individual can also be charged with Third Degree Sex Crimes if the victim is 13, 14 or 15 and he or she is 2 years older. Proof of sexual penetration is required

Fourth Degree Criminal Sexual Conduct – These Sex Crimes are similar to those in the Third Degree category; however, evidence of penetration is not required. Instead, only proof of sexual conduct is usually required.

Fifth Degree Criminal Sexual Conduct– Charges in this category usually concern any non-consensual sexual contact between the parties, such as attempting to remove clothing covering intimate parts and/or certain types of touching of sensitive areas.

Additional Sex Crimes

In addition to the conduct described-above, you could also face Sex Crime charges for child molestation, seeking sex from a minor, statutory rape, prostitution and solicitation, indecent exposure, Internet sex crimes, and possession of child pornography.
